These terms cover your use of papayacreative.co and how quotes and orders work with Papaya Creative Studio ("Papaya", "we"). A signed proposal or written quote for a specific project takes priority over these terms where the two differ.

Prices and quotes

Prices on this website are starting points. Scope and deliverables will determine final pricing.
All prices are in Canadian dollars and exclude HST, which is added at 13% for Ontario clients.
Before any work starts you receive a written quote. Work begins once you accept it and any deposit stated on it has been paid.
Meta ad spend is paid by you directly to Meta and is never included in our management fee.
Monthly plans (website care, growth, admin care and ads management) run month to month unless your quote says otherwise, and can be cancelled with 30 days' written notice.

Apparel orders

Submitting the order form on /shop is a request, not a purchase. Nothing is charged until we confirm stock, send a digital proof and you approve it.
The minimum order is five pieces in total. Prices per piece are based on the total pieces in the order.
You confirm you have the right to use any logo or artwork you send us. We may decline artwork we believe infringes someone else's rights.
Because garments are printed to order, approved and printed orders cannot be returned except for a printing defect, which you must report within 7 days of delivery.

Ownership

Once a project is paid in full, you own the final deliverables we make for you: website files and content, logos, ad creative and data in your systems.
Domains, hosting, ad accounts and Cloudflare accounts are set up in your name wherever possible.
We keep the right to reuse our own general methods, code libraries and know-how, and to show completed work in our portfolio unless you ask us not to.

Third-party services

Our work relies on services such as Cloudflare, Google and Meta. Their availability, pricing and rules are set by them, not us, and changes on their side are outside our control.

No guarantees of results

We do the work carefully and tell you plainly what is and isn't working, but we cannot guarantee search rankings, AI recommendations, ad performance, leads or sales.

Liability

To the extent the law allows, our total liability for any claim relating to a project is limited to the fees you paid us for that project in the three months before the claim. We are not liable for indirect losses such as lost profits.

Governing law

These terms are governed by the laws of Ontario and the federal laws of Canada that apply there.
